2008 Protest Procedure for all PCYC Fleet Racing Events

 

Sportsmanship and the Rules
Competitors in the sport of sailing are governed by a body of rules that they are expected to follow and enforce. A fundamental principle of sportsmanship is that when competitors break a rule they will promptly take a penalty or retire.

Filing a Protest
Protests shall be submitted on forms available at the Communications Centre or from the Race Committee. They must be submitted to the Race Officer for the event prior to the end of Protest Time (See Sailing Instructions). The Race Officer will note the time and date received and deposit the forms in the Communications Centre.

Protest Hearings
Protests will be heard on the Tuesday evening following the event commencing at 1900 hours. The location of the hearing will be posted on the Official Notice Board.

Protests will be heard in the order in which they were received.

Mediation

  • For protests under a rule of Part 2 in which there are only two parties involved and where there is no damage or injury to either boat, there will be a short mediation hearing.
  • After the protest has been properly filed, one designated representative from each boat shall attend before a mediator. No other witnesses shall be permitted. The mediator will decide on the validity of the protest(s) before commencing the mediation. This changes RRS 63.5
  • A boat that accepts the opinion of the mediator that she has broken a rule and accepts fault shall receive a 40% scoring penalty calculated as stated in RRS 44.3(c). This changes RRS A2.2
  • If the opinion of the mediator is not accepted then the matter will be referred to the protest committee and the 40% penalty will no longer be available.
  • When one boat accepts a penalty following a mediation hearing, her decision shall be binding upon the other party to the protest, and the protest shall not be referred to the Protest Committee. This changes RRS 63.1.
  • The mediator may approve the withdrawal of a protest. This changes RRS 63.1.
